Royal Lady I agree - if someone DID video it - then it would help our client's cause. If the police videoed it - it would show that it was indeed "bullshit" to arrest him over saying nothing and doing nothing. If the police have not videoed it then it's their word against our client's and they've not had the best of press recently....



i thought the police had to warn you first, and only be able to arrest you if you do it again

Nah. They can arrest you for anything these days without giving you a warning. The "warning" is normally a caution - and that now remains on your record for 100 years or something - so if people need an enhanced CRB check they can be right up shit creek - as it will show up and they could potentially lose a job.

I bet their testimony won't say "well your honour, a steward said he swore at them, so we rushed in, to grab him, he denied the charge and resisted arrest, so 9 of us bundled him to the ground giving him a bit of a slap and a kick as we did so, in order to ensure that he couldn't beat us all up. We haven't got any actual video footage, nor have we any witness statements, other than the steward who said the bloke swore. But the accused did say the allegation was bullshit, so we nicked him".

You are a little confused I think. When you are nicked for an offence you are 'cautioned' in so much as being advised of your right to silence. Do not confuse this with a formal police caution as an alternative to court proceedings, which can only be considered if the detained person admits his guilt - which sounds unlikely having read the thread - and also if the detained person has committed his first minor offence of this type. You are correct in saying that this will go on your criminal record for a number of years.

I was arrested for public order section 4a - swore at a steward apparently, when i was never within 15 foot of the guy who had claimed it. I stood my ground and said to them this is bullshit it's cost me a lot of money to get here and you are going on this? They took this as resisting so jumped on me, and then after about a few minutes of struggling suceeded into throwing me into the ground and causing me facial injuries (http://imageshack.us/photo/my-images/801/006hhy.jpg/) you can't see them that well, on the camera but it's obvious where they are.

What's your side for me being a 'oxf*rd'?

Look mate, I'm an old git whose son doesn't listen to a word he says. So I'll try my luck on you instead: FWIW i wouldn't be at all surprised if you've been harsly treated. Unfortunately it happens all the time. Best thing is not to give them any excuse at all to arrest you. Don't be aggressive, don't argue, just apologise. I know the old testosterone's a bit strong around your age but rise above it. You'v egot a brain. That way, you have the last laugh. Birmingham fan put his hand round my neck in the bus queue after the match 3-4 seasons ago after I confronted him about pushing in. I wanted to smack him in the face. What would have happened? The toe rag with a crappy job would have got off whereas me with the good job would have been arrested for fighting and lost mine. It ain't worth it. Keep mouth shut and hands down, unless of course you've nothing to lose (i.e. no job, etc). I've still got my job whereas he lives in a flea pit. 4 years on I'm still laughing. Ignore my advice and lurch from one spot of bother to another. Be my guest.

i meant just for swearing at a police officer. the guidelines say they must warn first before getting all arresty.
thats always whats happened/been told when ive done it anyway.
but i gather that th eswearing was happening while he was already been arrested, so dont count

No - he was arrested for having allegedly said a swear word to a steward. They bundled in on him when he was going to the toilet. Or something. He was only resisting arrest because he hadn't done anything wrong. So he swore and said "bull shit" to a police officer.

Thing is, the second he resists arrest, it doesn't matter if he's guilty or innocent, because it IS a crime to resist arrest and unfortunately you are arrested on suspicion, not on being proven guilty.
