Oh, you do know.blythspartan wrote:I think we’ll see a fire sale this month. What I don’t know is whether the money will be used to keep the club afloat for the rest of the season or be going straight to Dai.
Doesn't any money received belong to the club, not the owner, or can owners just take money out of any businesses they own any time they feel like it.blythspartan wrote:I think we’ll see a fire sale this month. Yes and no. You can only take money out of a limited company if it's a salary (including expenses); dividends (but only when the company makes a profit) and director's loans.Sutekh wrote:Doesn't any money received belong to the club, not the owner, or can owners just take money out of any businesses they own any time they feel like it.blythspartan wrote:I think we’ll see a fire sale this month. And hard to prosecute for individuals who don't give a oxf*rd outside the country, I imagine.WestYorksRoyal wrote:Dai and the directors must also be sailing close to the wind in terms of wrongful trading, which is where you know an entity may not be able to meet its obligations but you continue trading anyway. See the catering firm leaving because of the unpaid bill.
If Dai pocketed transfer money for himself and then the club had unpaid bills with HMRC/TVP/Horseman he would certainly cross this threshold and become personally liable for unpaid bills. Sadly it's a civil offence and not a criminal one.
